This Limited Warranty ("Policy") is provided by PokeSkulls, LLC dba MNSTR Assoc ("MNSTR Assoc," "Company," "we," "our," or "us") and applies to your access to and use of www.mnstrassoc.com (the "Website"), as well as the products and services we offer, where applicable.

This Policy forms part of our overall legal agreement with you and should be read together with our Legal Notice, Conditions of Use, Conditions of Sale, Privacy Policy, Product Safety & Care Policy, Limited Warranty, Returns & Refund Policy, Brand Protection Statement, and any additional policies or notices referenced on our Website. Together, these documents govern your relationship with MNSTR Assoc and are incorporated by reference where permitted by applicable law.

By accessing our Website, creating an account, placing an order, or otherwise interacting with MNSTR Assoc, you acknowledge that you have read and understand the policies applicable to your use of our Website, products, and services. Nothing in this Policy is intended to limit or waive any rights that cannot be excluded or restricted under applicable law.

This Limited Warranty ("Warranty") applies to eligible products purchased directly from PokeSkulls, LLC dba MNSTR Assoc ("MNSTR Assoc," "Company," "we," "our," or "us") through www.mnstrassoc.com or an authorized retailer, unless otherwise stated.

This Warranty is provided in addition to any rights you may have under applicable consumer protection laws. Nothing in this Warranty limits or excludes rights that cannot legally be waived.

1. WARRANTY COVERAGE

MNSTR Assoc warrants that eligible products will be free from defects in materials and workmanship under normal intended use during the applicable warranty period.

This Warranty applies only to manufacturing defects and does not guarantee that products will remain free from normal wear, cosmetic changes, or damage resulting from ordinary use.

2. WARRANTY PERIOD

Unless otherwise specified on the applicable product page, the Limited Warranty applies for one (1) year from the date of delivery to the original purchaser.

Proof of purchase is required for all warranty claims.

3. WHO IS COVERED

This Warranty applies only to the original purchaser of the product and is non-transferable.

Products acquired through unauthorized sellers, resale marketplaces, auctions, or private sales are not covered unless required by applicable law.

4. WHAT IS COVERED

Examples of manufacturing defects that may be covered include:

• defective solder joints;
• manufacturing cracks unrelated to misuse;
• defective clasps or hinges resulting from manufacturing defects;
• stone settings that fail due to manufacturing defects;
• significant manufacturing defects in plating or finishing present upon delivery;
• verified manufacturing defects in materials or workmanship.
  

Warranty coverage is determined solely after inspection by MNSTR Assoc.

5. WHAT IS NOT COVERED

This Warranty does not cover:

• normal wear and tear;
• scratches;
• dents;
• oxidation;
• patina development;
• finish or plating wear over time;
• discoloration caused by use;
• chain stretching;
• bent components resulting from excessive force;
• accidental damage;
• misuse;
• abuse;
• neglect;
• improper cleaning;
• improper storage;
• exposure to chemicals;
• exposure to chlorinated or salt water;
• impact damage;
• modifications;
• unauthorized repairs;
• unauthorized resizing;
• engraving performed by third parties;
• damage caused during shipping after delivery;
• loss or theft;
• cosmetic preferences;
• products intentionally altered after purchase.
  

Normal variations in handcrafted finishes, oxidation, polishing, or natural materials are not manufacturing defects.

6. PLATED FINISHES

Decorative finishes, including but not limited to rhodium, gold, ruthenium, palladium, oxidized, blackened, and specialty plated finishes, naturally wear over time.

Normal plating wear resulting from use, skin chemistry, friction, perspiration, cosmetics, or environmental exposure is not covered by this Warranty.

7. COLLECTOR PRODUCTS

Many MNSTR Assoc products are produced as limited-edition collectible items.

Limited availability does not extend or expand warranty coverage.

Collector products are subject to the same standards regarding manufacturing defects, normal wear, and accidental damage as other products.

8. WARRANTY CLAIM PROCESS

To submit a warranty claim, please contact:

Please include:

• your order number;
• proof of purchase;
• photographs of the product;
• a description of the issue; and
• any additional information reasonably requested to evaluate the claim.
  

MNSTR Assoc may request that the product be returned for inspection before making a warranty determination.

9. WARRANTY REMEDIES

If MNSTR Assoc determines that a product is covered under this Warranty, we may, at our sole discretion:

• repair the product;
• replace the product with the same item;
• replace the product with a comparable item if the original is unavailable;
• provide store credit; or
• issue a refund where required by law or where another remedy is not reasonably available.
  

The remedy provided under this Warranty is your exclusive remedy for covered manufacturing defects, except where applicable law provides otherwise.

10. SHIPPING FOR WARRANTY CLAIMS

Customers are responsible for shipping products to MNSTR Assoc unless otherwise required by applicable law or authorized by us in writing.

If a warranty claim is approved, MNSTR Assoc may reimburse reasonable return shipping costs or provide replacement shipping at its discretion.

Customers remain responsible for securely packaging returned products to minimize the risk of shipping damage.

11. LIMITATION OF WARRANTY

Except as expressly provided in this Limited Warranty and to the fullest extent permitted by applicable law, MNSTR Assoc disclaims all other express or implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Some jurisdictions do not allow limitations on implied warranties, so portions of this section may not apply to you.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, MNSTR Assoc shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from the use of any product covered by this Warranty.

Nothing in this Warranty excludes liability that cannot legally be excluded under applicable law.

13. MODIFICATIONS TO THIS WARRANTY

MNSTR Assoc reserves the right to update or modify this Warranty at any time.

Any modifications apply only to products purchased after the revised Warranty becomes effective unless otherwise required by law.

14. GOVERNING LAW

This Warranty shall be governed by the laws of the State of California, except where mandatory consumer protection laws require otherwise.
